1. Acceptance of Terms

By accessing or using AetherSoul.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and AetherSoul, Inc. ("Company," "we," "us," or "our").

2. Eligibility and Age Requirement

You must be at least 18 years of age to use this Service. In compliance with California Senate Bill 243 (SB 243) and other applicable regulations, we require age verification for all users. By creating an account, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into these Terms.
  • You will provide truthful and accurate information during the verification process.
  • You understand that misrepresenting your age is a violation of these Terms and may result in immediate account termination.

We reserve the right to request additional verification at any time and to suspend or terminate accounts where age verification cannot be confirmed.

3. Nature of the Service — AI Disclosure

All characters on AetherSoul are artificial intelligence ("AI") entities. They are not real people and do not possess consciousness, emotions, or independent agency. In accordance with California SB 243:

  • Every conversation includes a clear disclosure that you are interacting with an AI.
  • AI characters cannot and do not provide medical, legal, financial, or professional advice.
  • Interactions with AI characters should not be considered a substitute for professional mental health services, therapy, or counseling.
  • The Company is not responsible for any decisions you make based on interactions with AI characters.

4. User Safety and Crisis Protocols

AetherSoul incorporates automated safety systems designed to detect potential crisis situations, including but not limited to expressions of self-harm, suicidal ideation, or intent to harm others. When such content is detected:

  • The system will immediately provide crisis resources, including the 988 Suicide & Crisis Lifeline (call or text 988).
  • The AI character will respond with appropriate care and redirect to professional resources.
  • The event may be logged for safety monitoring purposes in compliance with applicable law.
  • Session break reminders are provided to encourage healthy usage patterns.

If you are in immediate danger, please call 911 or your local emergency services.

5. Account Registration and Security

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain and promptly update your account information.
  • Notify us immediately of any unauthorized use of your account.
  • Not share your account with others or allow others to access your account.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Generate, distribute, or facilitate content involving minors in any harmful context.
  • Harass, threaten, or intimidate any person.
  • Attempt to circumvent age verification or safety systems.
  • Use the Service for any illegal purpose or to solicit illegal activity.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Attempt to gain unauthorized access to any part of the Service.
  • Use automated systems (bots, scrapers) to access the Service without authorization.

7. Subscription and Payments

AetherSoul offers both free and paid subscription tiers. By subscribing to a paid plan:

  • You authorize us to charge the applicable fees to your payment method.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • You may cancel your subscription at any time through your account settings.
  • Refunds are handled in accordance with our refund policy and applicable law.
  • Virtual currency ("Coins") purchased within the Service have no real-world monetary value and are non-refundable except as required by law.

8. Intellectual Property

The Service, including all content, features, and functionality (including but not limited to AI characters, text, graphics, logos, and software), is owned by AetherSoul, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission.

9. User Content

You retain ownership of content you submit through the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving the Service. We do not sell your User Content to third parties.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHERSOUL, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
